US Court Orders Release of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling charges, he was detained in federal detention.

In her decision, the court noted that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Case

The legal challenge involve disputed claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

The judge, who was hearing his challenge to deportation in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
